Negotiation
Negotiation is a process wherein all parties cooperate in good faith discussion to identify issues, propose solutions, and resolve by way of written agreement. Negotiation is effective for drafting and executing Minutes of Settlement, Offers to Settle, Releases & Waivers, and Settlement Agreements. Negotiation relies on both parties being reasonable, transparent, and interested in a timely resolution.
Civil MediationÂ
Civil law mediation is an out-of-court resolution process that invites an early and cost-effective resolution of civil law claims. Adam T. Higgins can represent you in your civil law mediation process by attending the mediation to give you real-time legal advice that supports your goals for resolution. We can then work to ensure that the agreement reached in mediation is properly drafted into a formal written settlement and help you to collect what you are owed.
Litigation
Litigation means taking your dispute to Court to have a judge provide a resolution. Our lawyers regularly litigate in Small Claims Court, the Superior Court of Justice and have appeared at the Ontario Court of Appeal. Although we strive to reach an agreement without litigation, we are prepared for fearless advocacy from the start of a file to trial and appeal, when necessary.

Adam represented Queen's in the Ontario Trial Lawyer's Association Cup civil trial moot, where he won the awards for both Best Team and Best Closing Argument. Adam now teaches as the Civil Law course instructor at Nipissing University.
